Terms of Service

1. Introduction

Welcome to Canairy. These Terms of Service (“Terms”) govern your use of the Canairy mobile application and related services (collectively, the “Service”), provided by NunnCurtis Labs, LLC (“we,” “us,” or “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

2. SMS Messaging Terms (A2P 10DLC)

As part of our Service, you may opt-in to receive SMS notifications regarding air quality alerts. By opting in, you agree to the following terms:

2.1 Program Description

The Canairy SMS alert system sends users notifications about significant changes in air quality index (AQI) or specific environmental hazards (such as wildfires or high pollen counts) in their selected locations.

2.2 Message Frequency

Message frequency varies based on environmental conditions and your alert settings. You may receive multiple messages during active air quality events.

2.3 Cost

Message and data rates may apply. Check with your mobile carrier for details on your specific plan.

2.4 Opt-Out (Cancellation)

You can cancel the SMS service at any time. Just text “STOP” to the short code or phone number from which you received the message. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

2.5 Help

If you are experiencing issues with the messaging program you can reply with the keyword “HELP” for more assistance, or you can get help directly at privacy@nunncurtislabs.com.

2.6 Carrier Liability

Carriers are not liable for delayed or undelivered messages.

2.7 No Marketing

This SMS program is strictly for informational alerts regarding air quality. We will not use your phone number for marketing or promotional purposes.

3. Use of the Service

You agree to use the Service only for lawful purposes. You are responsible for all activity associated with your account. You agree not to:

  • Use the Service in any way that violates applicable federal, state, local, or international law.
  • Attempt to gain unauthorized access to any portion of the Service.
  • Interfere with or disrupt the integrity or performance of the Service.

4. Location Data

Canairy requires access to your location data to provide accurate local air quality information. By using the Service, you consent to our collection and use of your location data as described in our Privacy Policy.

5. Intellectual Property

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of NunnCurtis Labs, LLC and its licensors.

6. Disclaimer of Warranties

The Service constitutes a tool to help you monitor air quality. However, we do not guarantee the accuracy, completeness, or timeliness of the air quality data, which is often sourced from third parties. The Service is provided on an “AS IS” and “AS AVAILABLE” basis.

7. Limitation of Liability

In no event shall NunnCurtis Labs, LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any significant changes.
